New employers, who are due to become subject to automatic enrolment duties during 2017 and are known as ‘post-staging employers’, will benefit from draft legislation that

  • provides certainty about when AE duties apply to new employers outside the AE staging profile
  • extends to them the option to defer automatic enrolment for their workers – a compliance easement, which is currently available only to employers in the staging profile

‘Automatic enrolment: technical changes (2017)’, which links to the consultation and the draft regulation, relates to proposals made in advance of the outcome of the 2017 Review of AE, which will look at whether AE continues to meet the needs of individuals saving for their retirement in the future. This allows the measures to be in place before the existing provisions in the Employers’ Duties (Implementation) Regulations 2010 start to apply to new employers in April 2017.
