The Governments Industrial Strategy and late payments

Following on from the appointment of the new Small Business Commissioner, Emma Jones CBE, we note that the Governments new Industrial Strategy also mentions Late payments.

You have to get all the way to page 156 of 160 (i hope that doesn’t bode for its significance) I was pleased to find the following the following :

Continue to tackle the challenge of late payments to SMEs by:

− Undertaking significant reforms, including a new Fair Payment Code, upcoming legislation to require large companies to include their payment performance reporting within annual reports, and an upcoming consultation on potential legislative measures to go further.


− Appointing Emma Jones CBE as the new Small Business Commissioner, effective from 23 June 2025. The SBC will play a key role in tackling late payments and long payment terms
for small businesses and the self-employed, including through delivery of the new Fair Payment Code.

− Proposing to exclude suppliers who do not pay their contractors on time from a wider range of public sector contracts, extending this beyond central government bodies, and to
set targets for direct spend with SMEs as part of our forthcoming consultation on reforms to public procurement.

So that bit in bold! An upcoming consultation on potential measures to go further! That’s intriguing!  Will we see increased penalties for late payment? Could compensation and interest be increased or made compulsory. At the moment it is too easy for late payers to use the size, strength and the threatened removal of goodwill to make their SME suppliers unable to ask for late payment interest and compensation. If it was made compulsory for companies to pay it, then it would have a rapid and far reaching affect on payment behaviour.

Perhaps we are also going to see other changes to late payment legislation such as the removal of unfair contract terms.  Lets Watch this space!
