Paid leave rights for bereaved parents (UK)
Employed people who lose a child under 18 years old and have at least 26 weeks continuous service will have a right to 2 weeks paid ‘statutory bereavement leave’ to allow them time to grieve, under the ‘Parental Bereavement (Leave and Pay) Bill’, which is currently going through the parliamentary process and should become law in 2020.
Under the proposed regulations, small firms will be able to recover all statutory bereavement pay, while larger employers will be able to reclaim most of it.
‘Parental Bereavement (Leave and Pay) Bill: Explanatory Notes’ explain what each part of the Bill will mean in practice and provide additional information on how the Bill will affect existing legislation.
Under the Employment Rights Act, employees currently have a day-one right to take a “reasonable” amount of unpaid time off work – usually agreed between employer and employee – to deal with emergencies such as making arrangements following the death of a dependant.
In September 2014 Acas published ‘Managing bereavement in the workplace – a good practice guide’ to help employers develop a clear bereavement policy and appropriate training for management and selected staff.
