Tory Rebels Force Rethink Over Rights To Sue Government
Conservative rebels recently forced ministers to reconsider their plans to remove the right of citizens to sue the government for damages after Brexit.
Ministers had insisted that they would scrap so called ‘Francovich’ rules that allow individuals and companies to take legal action against the government for breaching retained EU laws after Britain leaves the European Union.
However, facing a backbench rebellion led by Dominic Grieve, the former attorney-general, ministers decided they would re-evaluate their plans in an attempt to find a compromise.
The rebels reminded ministers that without this right to sue the government, citizens would be unable to hold the government to account for breaches of laws such as air pollution limits.
These so-called ‘Brexit Mutineers’ had recently fought the government over their plans to implement a withdrawal date into Brexit legislation, reducing any flexibility with negotiations with the EU.
The climbdown is another such victory for the mutineers, and suggests that the government felt it did not have the numbers to force through the measures in a Commons vote.
The government announced they would bring forward their amendment to the Withdrawal Bill at a later stage.
Robert Buckland, the solicitor-general, told the Commons: “We can agree that there should be appropriate mechanisms for challenging the actions of the executive”. He added the government had no wish to remove any substantive rights enjoyed by British citizens.
